1. Scope of Application
These General Terms and Conditions apply to the use of the TournamentPilot platform, operated by Raphael Polig (hereinafter referred to as the 'Provider'). The use of the platform is free of charge and is intended for private individuals and associations.
2. Description of Services
TournamentPilot provides tools for organizing and publishing tournaments, including real-time data synchronization and the possibility to upload text and images. There is no claim to constant availability of the service or permanent storage of data. The Provider reserves the right to adapt, restrict, or discontinue the service at any time without giving reasons.
3. Content, Images, and User Obligations
Users are solely responsible for the content they enter (e.g., tournament names, participant names, uploaded images) and the technical storage of session data in their browser's local storage. When uploading images — including sponsor logos — the user guarantees that they hold the necessary copyrights or have obtained explicit permission from the rights holder. If persons are depicted, the user is responsible for obtaining their consent. The upload of illegal, glorifying violence, discriminatory, or pornographic content is prohibited. Regarding links to external sponsor websites, the Provider accepts no liability for their content. The user grants the Provider the simple right to store and display content within the framework of the platform's functions. The Provider does not review content in advance but reserves the right to delete inadmissible content at any time.
4. Disclaimer and Indemnification
Use of the service is at the user's own risk. To the extent permitted by law, any liability for direct or indirect damage, as well as for loss of data, is excluded. The user indemnifies the Provider against all claims by third parties (including reasonable legal costs) arising from violations of copyright, trademark, or personal rights caused by the content provided by the user. The service is provided 'as is' without any warranty.
5. Final Provisions
Swiss law shall apply. Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected. The place of jurisdiction is the residence of the Provider, unless another mandatory place of jurisdiction exists.
